These Terms of Service ("Terms") govern your access to and use of the OneMenu platform, website and related services ("Services"). By accessing or using OneMenu, you agree to be bound by these Terms.
2. About OneMenu
OneMenu provides software that enables hospitality businesses to create, manage and distribute menu content across digital and print channels, including websites, search platforms and other integrated services.
3. Eligibility
You must be at least 18 years old and authorised to act on behalf of the business using the Services.
You are responsible for ensuring that all users accessing your account comply with these Terms.
4. User Accounts
You are responsible for:
Maintaining the confidentiality of account credentials
All activity occurring under your account
Ensuring information provided to OneMenu is accurate and current
You must notify us immediately of any unauthorised use of your account.
5. Subscription Services
Certain features of OneMenu may require payment of subscription fees.
Subscription fees:
Are payable in advance
May be charged monthly or annually
Are non-refundable except where required by law
We reserve the right to change pricing with reasonable notice.
6. Customer Content
You retain ownership of all menu content, images, branding and other materials uploaded to OneMenu ("Customer Content").
By using the Services, you grant OneMenu a non-exclusive licence to use, process, reproduce and distribute Customer Content solely for the purpose of providing the Services.
7. Acceptable Use
You agree not to:
Use the Services unlawfully
Upload content you do not own or have permission to use
Attempt to interfere with platform security
Reverse engineer or copy the software
Use the Services in a way that could damage OneMenu or other users
8. Third-Party Integrations
OneMenu may integrate with third-party platforms including websites, search engines, business listings and other software providers.
We are not responsible for:
Third-party platform availability
Changes made by third-party providers
Errors caused by third-party systems
9. AI-Assisted Features
Where OneMenu provides AI-assisted functionality, generated content may require review before publication.
Customers remain responsible for verifying the accuracy of all published content.
10. Availability
While we strive to provide uninterrupted access, we do not guarantee that the Services will always be available, error-free or uninterrupted.
Scheduled maintenance and system outages may occur.
11. Intellectual Property
All intellectual property rights in OneMenu, including software, branding, designs and content (excluding Customer Content), remain the property of OneMenu.
12. Limitation of Liability
To the maximum extent permitted by law:
OneMenu is provided "as is"
We exclude all implied warranties
Our liability is limited to the amount paid by you for the Services during the preceding 12 months
We are not liable for indirect, consequential or loss of profit damages.
13. Termination
We may suspend or terminate access if:
These Terms are breached
Subscription fees remain unpaid
Use of the Services creates legal or security risks
You may cancel your subscription at any time.
14. Governing Law
These Terms are governed by the laws of South Australia, Australia.
Any disputes will be subject to the exclusive jurisdiction of the courts of South Australia.
